Accepting Documents

The County Recorder will accept any document that is authorized or required by California law to be recorded.

Please note, beginning April 1, 2010, a Transfer Tax Affidavit form must be completed and submitted when recording any deed that is exempt from transfer tax.

Requirements

The document must be photographically reproducible and contain proper information, such as:

  • An Assessor Parcel Number (APN) is required for all documents that transfer an interest in real property. A Preliminary Change of Ownership Form must also be included. Please use the current form, BOE-502-A -rev 15 (02-21). Form numbers can be found in the top left hand corner of the form.
  • The document should name the person requesting the recording. Names must be printed or typed under all signatures and business names.
  • The property must be located in Merced County.
  • The document should have a name and address of where the document should be sent after recording.
  • Documents affecting title to real property must have proper notary acknowledgment.
  • Additional requirements may apply depending on the type of document.

Obtaining Copies of Recorded Documents

The following information must be provided in order to obtain copies of recorded documents:

  • Type of document
  • The document number (book and page number if document has one)
  • The recording year
  • Name of at least one of the parties named in the document
  • Name and address of the person or agency to whom the copies are to be returned

Government Code Section 27388.1 - Building Homes & Jobs Act

Effective January 1, 2018, in order to fund the State’s Building Homes & Jobs Act (SB2), Government Code section 27388.1 requires that documents accepted for recording at the Merced County Recorder’s Office be charged an additional seventy-five ($75) fee as follows:

Only an expressly limited number of statutory exemptions exist regarding the collection of this fee. When an exemption is applicable, a valid declaration of exemption must be placed on the face of each document prior to depositing with the Recorder, otherwise the fee will be assessed and collected. Following are samples of applicable statutory exemptions to be used on the first page of each document:

  1. A Documentary Transfer Tax (DTT) Declaration stating that the transfer is subject to payment of the DTT including the amount of DTT due and to be paid at the time of recording; and/or
  2. Exempt from fee per GC sec 27388.1(a)(2); recorded concurrently "in connection with" a transfer subject to the imposition of DTT ; or
  3. Exempt from fee per GC sec 27388.1(a)(2); recorded concurrently "in connection with" a transfer of real property that is a residential dwelling to an owner-occupier; or
  4. Exempt from fee per GC sec 27388.1(a)(1); fee cap of $225 reached; or
  5. Exempt from fee per GC sec 27388.1(a)(1); not related to real property.

Failure to include a specified statutory exemption reason will result in the imposition of the $75 Building Homes and Jobs Act fee. Claims for exemption will be reviewed for validity. Merced County will collect the fees as outlined under guidance received from the County Recorders Association of California and Legislative Counsel. Fees are collected on behalf of the State and are deposited with the State for funding of the State program.

Payments

Our office no longer accepts checks as payment except for recordings of documents. Credit and debit card payments can be accepted in our office. There is a $2.50 fee for the use of credit and debit cards.

You may have difficulty searching for your tax bill because your address on the deed may have been recorded with abbreviations.

  • Try entering the address without the Street, Road, Drive, or Lane in the property address search cell.
  • Try entering only the first letter for directional identifiers like
    N for North
    E for East
    S for South
    W for West

Example

Example Address: 1234 West 32nd Street

  • Search by 1234 and scroll down to your find your street name.
  • Search by 1234 W (do not type out West) and scroll down to find you street name.
  • Search by 1234 W 32nd (do not enter Street or St.) and you should go directly to your property address.
