This Board hears cases involving property which houses prostitution, controlled substance activity, stolen property, and criminal gangs. It has the power to declare such properties a public nuisance, to enter orders prohibiting the maintenance of the nuisance, and assess fines up to $250 per day and up to $500 per day for recurring public nuisances.

Code Enforcement FAQs

  • Are garage sale permits approved per person or per address?

    The permit is approved per address and owner. Permits are approved as long as there are 6 months between applications and limited to 2 per year. However, if there is a new owner of a property, they would have the opportunity to obtain 2 permits (6 months apart) whether or not the previous owner had obtained a permit in the past 6 months.

  • Can I have a canopy or shade tent on my property and do I have to get a permit for this?

    Yes.Canopy tents/shades are permitted in Residential and Estates zoned areas. You must apply for and receive approval for a permit prior to adding to your property. In addition, the structure must be erected in accordance with setbacks and restrictions of the Collier County Building Permit. These structures may only be used for the storage or parking of recreational vehicles, vehicles authorized in residential areas, and as a sunshade for outdoor activities. 

  • Can I leave my furniture or appliances out in the right-of-way to be picked up?

    You must call Collier County Utility Billing and Customer Service 48 HOURS IN ADVANCE of your recycling day to schedule a pick-up of any appliances, electronics, and other bulky items. Call (239)252-2380 to schedule collection and then place the items curbside before 6:00 a.m. on your collection day (no earlier than 6:00 p.m. the night before).

  • Can I leave my garbage can out in the right-of-way on non-pickup day?

    No. Garbage containers may only be placed in the right-of-way between the hours of 6:00pm the day before, and until 6:00pm the day of your scheduled pickup.

  • Can I leave my yard trash in the right-of-way to be picked up?

    Please call Collier County Utility Billing and Customer Service(239) 252-2380 for any questions regarding trash collection. Yard waste collection is on the same day as your recycling collection. Yard waste must be prepared for collection by either:
    • Placing in personal containers no larger than 35 gallons, weighing no more than 50 pounds when filled.
    • Placing in paper bags.
    • Tying in bundles no longer than four feet in length.
    • No branches thicker than four inches in diameter.
    • No more than ten (10) bundles or containers.
    • No Plastic Bags.
    • No yard trash in Waste Management green containers.

  • Can I park my boat, boat trailer or camper at my house?

    In regards to Residential zoned areas, Recreational Vehicles may be parked or stored only in a rear yard, or in a completely enclosed building, or in a carport, or on davits or cradles adjacent waterways on residentially zoned property.
    Recreational Vehicles are prohibited from parking in the front and side of properties unless it meets one of the following conditions:
    1) Vehicle is parked under a carport
    2) Vehicle is parked in a completely enclosed building
    3) Vehicle is parked for a period not exceeding six (6) hours within seven (7) day time period for the purpose of  loading/unloading, and/or for cleaning prior to or after a trip.
    4) 48 hour Recreational Vehicle Permit has been obtained from the Collier County Code Enforcement Department.
    5) 7 day Recreational Vehicle Permit has been obtained from the Collier County Code Department.

    The Estates and Agricultural zoned areas are exempt from recreational vehicle parking or storage restrictions.

  • Can I park on the grass or on the swale?

    It is prohibited to park in the grass for properties zoned for residential use in Mixed Use Urban Residential Land Use areas (Agricultural zoning districts including Estates is exempted). Refer to Land Development Code 04-41 as amended, Section 4.05.03 for details regarding requirements for parking. Parking on the street, swale, or Country right-of-way is prohibited in any zoning district.   

  • Can I plant vegetation along the roadside of my property?

    No. All construction activities, excavation, or obstruction on designated Collier county right-of-ways requires a permit, with exception to mailboxes, which must be mounted on a break-away type post.

  • Can I put a (fence, pipe, landscaping, and structure) in the drainage easement on my property? What do I need to do for permission?

    Sometimes this is allowed. You will need to obtain a letter of no objection and a permit. To get started please call Permitting at (239) 252-2400.

  • Can I put my fence on the property line?

    Yes. You may erect the fence on your property line with the finished side of the fence facing your neighbor’s property or the street. A Collier County Building Permit must first be obtained.

  • Can I sell my car on the corner of my street?

    No. You may only sell your vehicle from your property. Parking on the street, swale, or County right of way is prohibited in any zoning district.

  • Can I sell produce, flowers or other items along roads in Collier County?

    No. County codes prohibit selling anything from the roadside (right-of-way) in Collier County. This includes solicitation of monies for organizations.

  • Can my guests from out of town stay in my motor home located on my property?

    No. Recreational equipment may not be used for living, sleeping, or housekeeping purposes in Residential or Estates zoned districts, or any other property not specifically zoned for that purpose or use.

  • Can you make a code complaint for short term rental?

    Yes, you can file a complaint and Code Enforcement will ensure the rental has a Dept. of Business and Professional Regulations registration and a business tax receipt.

  • Do horse or livestock shelter/feeding structures need building permits?

    Yes in most cases. You must check with Collier County Building Department customer service. If the Collier County Building Department determines no permit is needed, the shelter/ feeding structures will still need to be a minimum of 30 feet from any lot line, and a minimum of 100 feet from any residence on an adjacent parcel of land.

  • Do I have to give out my information when reporting a complaint?

    Yes, unless the complaint is determined to be health and safety or something that causes irreparable damage the investigator may need contact you in the event they need further assistance identifying the location.

  • Do I need a building permit to install or build a shed on my property?

    Yes. Citizens must apply for applicable permits for any building or structure that is erected, altered, utilized or allowed to exist on his/her property. There are also requirements associated with each of the zoning districts that pertain to setbacks and permitted uses.

  • Do I need a permit for a garage sale, lawn sale, and/or other temporary sale on my property?

    Yes. A Garage Sale permit is required. To obtain a Garage Sale permit please contact Collier County Code Enforcement Department located at 2800 North Horseshoe Drive, Naples.

  • Do I need a permit to add or repair a fence to my property?

    Yes. A fence is considered a principle use and you are required to obtain a permit. Fences must meet all height requirements for specific zones and property types identified in the Land Development Code in Chapter Five, Sections 5.03.02(A through I). Please click here to read more about fence requirements Land Development Code in Chapter Five, Sections 5.03.02(A through I).

  • How do I cancel or reschedule my garage sale?

    Please call the Code Enforcement at 239 252 2440 to cancel or reschedule a garage sale. Most garage sales occur on the weekend when we do not have staff available. To request cancellation, leave the property address, owner name, and permit number on the phone messaging system and staff will make note on the records that the permit was cancelled for that particular date/property/owner. If there is no request to cancel, records will indicate that there was a garage sale at the property. If there is no request to reschedule, you may be found in violation of county codes for holding a garage sale on dates that were not approved on your permit.

  • How long is the garage sale permit good for?

    The permit is good for 2 consecutive days as indicated on the approved permit.

  • How much does a garage sale permit cost?

    There is no cost for a garage sale permit.

  • I plan to hold a sidewalk sale in front of my store. What do I need?

    Temporary sales events (grand openings, special promotional sales outside of a building, tent sales, and more) require a Temporary Use Permit that must be obtained in advance. For applications, please visit Zoning Services Department located at Growth Management Division 2800 N. Horseshoe Drive, Naples or download the application. Please visit or call Zoning Services Department 239-252-2400 for any questions regarding Temporary Use Permits. There is a cost associated with obtaining a Temporary Use Permit.

  • I plan to open a business at a building that already has a sign displayed on the wall outside. Can I simply remove the previous tenant's advertisement and insert letters advertising my business?

    No. It will be required a new Sign Permit. Collier County permits or other Collier County authorization is required for any signs that are to be altered or modified in structure, and for any sign copy changes. For more information please visit the Growth Management Division 2800 North Horseshoe Drive, Naples or call (239) 252-2400.

  • I plan to sell my house. How big can my "for sale" sign be?

    If your property is less than 1 acre, you are allowed 1 sign that is limited to 4 sq ft. This can be a ground sign (which is also limited to 6 ft in height) or a wall sign. The sign must also be at least 10 ft from any adjacent residential property, and can be located on your property line abutting the right of way.

  • I use reclaimed water, can I water anytime?

    No. Collier County is currently under a year round water restriction as imposed by South Florida Water management emergency order 40E-24F.A.C. Reclaimed water users are prohibited from watering between the hours of 10:00 AM to 4 PM.  To read more about this year round restriction, click here. 

  • If I purchase a property in Collier County that I later find has code violations that were committed by the previous owner, Am I responsible for the costs to correct them?

    Yes. As owner of the property, you are responsible to correct any code violation associated with your property. We recommend that you research any property before you purchase it, including permits for any additions, sheds, carports, fences or the like. When purchasing a home with existing code liens and/or code violations please contact Code Enforcement Department immediately and request to speak with a manager or supervisor because you may be eligible for fine reductions.

  • If I want to clear my vacant property, am I required to obtain a permit?

    Yes. A permit is required to clear vegetative growth on your property. There is a cost associated with removal of vegetation. Learn more about a Vegetation Removal Permit or contact Environmental Services in the Planning & Zoning Department, (239) 252-2400.

  • Is an Occupational License all that is needed? (an occupational license is now referred to as a business tax receipt)

    No. Other required documents could include a Fire Inspection, a Zoning Certificate from the Planning Department, and registration with the State of Florida, among others.   • Is it true that I don’t have to apply for a permit unless the cost of my building is a certain amount?

    We strongly urge you to contact the Collier County Building and Permitting Department before beginning any type of remodel/construction. This department will advise if a permit is or is not required for the work you intend to do. There are some permit exemptions for owners of single family detached residences. Collier County Building and Permitting Department is located at the Growth Management Division, 2800 North Horseshoe Drive, Naples.

  • My community would like to hold a collective garage sale. What do we need to submit for our permit?

    For community garage sales, we will need the address for the clubhouse. For safety precautions, if your community has issues with ingress/egress or you expect a large turnout, it is suggested that you contact the sheriff’s office to hire someone to assist with directing traffic so that parking violations are not created in your community during the sale.

  • My neighbor mows his lawn at 7:30 am. I work nights and can't sleep when the mower is going. Is there any ordinance that you can enforce to make him mow later in the day?

    No. Operation of equipment or conduct of activities normal to residential or agricultural communities such as but not limited to: lawn care, domestic power tools, lawn mowers, maintenance of trees, agricultural equipment, saws and tractors, and other normal community operations are exempted from sound level restrictions from 7:00 am to 10:00 pm, any day of the week. This does not mean someone cannot mow their lawn or other activities mentioned above prior to 7:00 am. If these activities occur before 7:00 am or after 10:00 pm, applicable sound level restrictions will apply. Please contact Collier Code Enforcement Department and request to speak with a Noise Specialist if you have any questions. 

  • My neighbor sometimes parks the box truck for his landscaping business in his driveway. Is this allowed in my residentially zoned neighborhood?

    The Estates and Agricultural District are excluded from the following restrictions:

    It shall be unlawful to park a commercial vehicle or commercial equipment on any lot in a Residential District, unless one of the following conditions exists: 
        (1) The vehicle and/or equipment is engaged in a construction or service operation on the site where it is parked. The vehicle or equipment must be removed as soon as the construction or service activity has been completed. 
        (2) The vehicle and/or equipment is parked in a garage or fully enclosed structure or carport which is structurally or vegetatively screened and cannot be seen from adjacent properties or the street serving the lot. 
        (3) The vehicle is parked in the rear of the main structure and is enclosed within a vegetative screening which conceals the vehicle from the view of neighbors. 
        (4) Automobiles, passenger type vans, and pickup trucks having a rated load capacity of one ton or less, all of which do not exceed 7.5 feet in height, nor 7.0 feet in width, nor 25 feet in length shall be exempted from this section unless otherwise prohibited by a special parking overlay district created pursuant to LDC Section 2.03.07M. 
        (5) Exempted from this section is small commercial equipment such as ladders and pipes that cannot be contained in the vehicle. Said equipment shall be limited to one ladder or one unit of pipe which does not exceed 12 inches in diameter per commercial vehicle. Said equipment shall be secured atop the vehicle and shall not extend beyond the length, height or width of the vehicle.

     

  • My neighbor's dog barks all day long while they are at work. Can you do anything about that?

    No.Code Enforcement does not take sound readings for barking dogs. We would suggest that you contact Domestic Animal Services at (239) 252-7387.

  • There's water standing on my property, what will the county do about it?

    We cannot provide services on private property or services under the jurisdiction of another agency. Common requests for services that cannot be performed or that will be referred to others include the following:

    Driveway repair (property owner) - Tree removal (private property) - Fences and Walls (private property) - Ditches not in easements

    Water and sewer problems will be referred to appropriate utility company. Private roads (lime rock or paved) not dedicated to the public or the county and formally accepted by the Collier County Board of County Commissioners for maintenance.
  • To run a daycare at my home, do I need to obtain a Collier County permit?

    Yes. You will need to meet certain requirements and receive zoning approval. For more information please contact Zoning Services Department (239) 252-2400 or visit Growth Management Division 2800 N.   • We live behind a commercial shopping center, the restaurants sometimes have a Live Band or a DJ, are they required to get any type of permit for the music?

    An Amplified Sound Permit is required for any commercial business or nonresidential land use (such as but not limited to: public park, amphitheater, fraternal organization, or church) which conducts outdoor entertainment activities within 2,500 feet of any property of residential use or residential zoning district.

  • What are the hours allowed to do construction?

    Any construction activities and site preparation activities shall only occur during the hours of 6:30am-7:00pm Monday through Saturday. No construction activities or site perpetration activities are permitted on Sundays or on the following holidays: New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day.

  • What do I need to put up a banner in front of my store?

    You will need a Temporary Use Permit obtained in advance from the Front Desk Planner at Community Development and Environmental Services, 2800 N Horseshoe Drive, Naples. There are restrictions on the size and placement of all temporary signs or banners placed with a Temporary Use Permit. If you are a tenant on the property, the owner's written permission must be obtained and brought in to the Planner. Any banner placed without a Temporary Use Permit is an illegal sign. There is a cost associated with obtaining a Temporary Use Permit.

  • What if I don’t get a Garage Sale permit?

    Because a garage sale permit is required, you may be found in violation of county codes.

  • What if I don’t get a permit before I start work on the addition to my home?

    You may be charged after-the-fact fees and/or a variance may be required if setbacks aren't met. If you are found in violation by Code Enforcement Department and do not comply, you may be subject to other fines. We urge you to speak with a permitting technician at Collier County Growth Management Division located at 2800 North Horseshoe Drive, Naples.

  • What is a Right-Of-Way?

    The Right-of-Way is land dedicated, deeded, used, or to be used for a street, alley, walkway, boulevard, drainage facility, access for ingress and egress, or other purpose by the public, certain designated individuals, or governing bodies.

    It shall be unlawful for any responsible party to dig, excavate, obstruct, or place any construction or other material, or perform any other work which disturbs the existing structure and/or compaction of soil in any right-of-way provided for public use in Collier County, including any public right-of-way maintained by Collier County within the boundaries of any municipal corporation, without first obtaining a permit for such work from the Collier County Transportation Operations Department.  

  • What kind of animals can I have in the Estates District?

    You are able to keep horses and/or livestock (no hogs/pigs unless you meet certain requirements), not to exceed two such hoofed animals per each acre. No open feedlots for horses and/or livestock, and any roofed structure for the shelter and feeding of such animals shall be a minimum of 30 feet from any lot line and a minimum of 100 feet from any residence on an adjacent parcel of land. You are able to keep fowl or poultry, not to exceed 25 in number, such fowl or poultry must be kept in an enclosure located a minimum of 30 feet from any lot line, and a minimum of 100 feet from any residence on an adjacent parcel of land.

  • What kind of animals can I keep as pets if I live in a Residential zoned area?

    The code regulation more specifically list the types of animals you are not allowed to keep in Residential zoned areas. The following animals are to be considered farm animals, and are not to be kept in residential zoned districts: turkeys, chickens, ducks, geese, pigs, horses, cows, goats, hogs, and the like.

  • When do I need an Occupational License (Business Tax Receipt)?

    As a general rule, if you make an income and own your business, you need a Business Tax Receipt (known prior as an Occupational License). This includes home-based businesses and one-person companies that do handyman chores. The Business Tax Receipts are issued by the Collier County Tax Collector and must be renewed annually. Certain skilled laborers and craftsmen must also have a Contractor's License.   • Where can I place my garage sale signs?

    You may place 2 temporary garage sale signs only on the property where the sale is being conducted. No signs can be placed in the County right of way, to include sidewalks, utility poles, traffic sign poles, medians, etc.

  • Where do I obtain a garage sale permit?

    The Garage Sale permit can be obtained at three locations. Permits can be obtained at the Code Enforcement Department located at 2800 North Horseshoe Drive in Naples, Code Enforcement Department at 310 Alachua Street in Immokalee, or at the North Collier Government Center at 2335 Blossom Drive (next to Collier County Headquarters Library).

  • Who can I call about flooding caused by a construction site?

  • Who can I call to report the music blasting in the middle of the night?

  • Why do I have to obtain a garage sale permit?

    Collier County Land Development Code requires a permit at no cost for garage sales held in residentially zoned areas of the county. All garage sales, lawn sales, and other similar temporary sales to be held at a private home, churches, and other places of worship, community centers, or other nonprofit residentially zoned institutions must have a garage sale permit.
